Terms of Service

The terms on which we provide the CPL app to your organisation and to you as one of its users.

These terms

These terms apply to CPL, the production logging application published by CustomEApps (Pty) Ltd, registration number 2025/952060/07 ("CustomEApps", "we", "us"), on Windows, macOS, Android and iOS, and to the service behind it (the "Services"). By using the Services you agree to them. If you do not agree, do not use the Services.

CPL is supplied to organisations under a separate agreement with CustomEApps. Where that agreement says something different from these terms, the agreement applies.

Accounts and access

  • CPL accounts are created by invitation from your organisation. You must be authorised by that organisation to use it, and you must be at least 18.
  • Keep your password to yourself. You are responsible for what is done under your account.
  • Tell your administrator at once if a device is lost or you think someone else has used your account, so the device or account can be revoked.
  • Your organisation decides your role and may change or remove your access. We may suspend access where it is needed to protect the Services or where these terms are broken.

Acceptable use

You agree not to:

  • knowingly enter false or misleading records, or alter records to conceal what happened;
  • access data, sites or functions your role does not allow, or try to get around access controls;
  • reverse engineer, copy or resell the Services, except where the law does not allow that restriction;
  • interfere with the Services or use them to break any law.

Your organisation’s data

The records entered into CPL belong to the client organisation. We use them only to provide the Services to that organisation, as set out in our Privacy Policy.

CPL records who entered and changed each figure. Those who capture and approve records remain responsible for their accuracy.

What CPL is, and is not

CPL records and reports production, machine hours, downtime and related figures to support management decisions. Its targets, rates and reports are calculated from what users enter and from settings your organisation controls. It is not a safety, machine-control or statutory reporting system and must not be relied on as one. Decisions about safety and legal compliance on site remain your organisation’s.

Availability and updates

CPL is built to keep working without a connection and to synchronise when one returns, but we do not promise that the Services will be uninterrupted or error-free. We release updates to fix faults and add features; some updates are required before the app can be used again, so that every device works on the same version of the data.

Intellectual property

The Services, including their software, design and trade marks, belong to CustomEApps or its licensors. You receive a limited, non-exclusive, non-transferable right to use them for your organisation’s internal business while its agreement with us is in force. Third-party components are used under their own licences.

Warranties and liability

The Services are provided "as is". To the fullest extent the law allows, we exclude warranties not expressly stated in these terms or in your organisation’s agreement, and we are not liable for indirect or consequential loss, including loss of production, profit or data, arising from use of the Services.

Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot be excluded, or any liability that cannot lawfully be limited.

Ending use

You may stop using the Services at any time. Access to CPL ends when your organisation removes it or when its agreement with us ends. How data is handled afterwards is described in the Privacy Policy.

Governing law

These terms are governed by the laws of the Republic of South Africa, and its courts have jurisdiction over any dispute.

Changes to these terms

We may update these terms. The effective date at the top shows the current version, and continued use of the Services after a change means you accept it.
